Married for 16 years. 5 (youngest is 9). I have been sole bread winner for 16 years and supported wife as a full-time student for last 5 years. I work from home so I have taken on most of household responsibilities over last 5 years while she is at school, in addition to working from home and providing only financial support for family. Wife recently filed for divorce. One lawyer I consulted stated that she found her timing interesting. Wife has a little less than two years remaining in school, and the lawyer stated our divorce likely take 18 months. The lawyer thinks she intends to have divorce decree prior to her finishing her degree. Since in NY state a degree or license can be regarded as marital property it is also my thought she is attempting to avoid my ability to have any claim on her future earninigs. Keep in mind she still has almost two years of school left so she intends to complete her full-time program while living on maintenance money from my earnings. Does anyone have any experience with this area of law? I am familiar with the case that set precedence in NY state, but I do not know of any subsequent rulings that extend beyond the initial ruling. If my wife has her way she likely obtain a divorce before she completes her degree. I could drag it out, but that is not for anyone, most of all our. I have no degree, so my wife be more educated than myself with more earning potential and more job security. Any advice?
